This is the process of changing your nonimmigrant status from your current nonimmigrant status, such as B-1/B-2 tourist status or J-1 student status (often used in Work and Travel or Au Pair programs), to F-1 student status. 1. B1 (business visa):
- Attending business meetings, conferences, negotiations.

2. B2 (tourist visa):
- Tourism, sightseeing, vacation.
- Visiting family or friends living in the United States.
- Participating in social events such as festivals, concerts.
- Medical treatment in the U.S.
- Short-term courses of study (no more than 18 hours per week) that do not lead to an academic degree.
It is important to note that the B1/B2 visa does not authorize long-term study, employment, or permanent residence in the United States.
If you wish to extend your stay, you may apply for an extension through USCIS (U.S. Citizenship and Immigration Services) before your authorized period of stay expires. If approved, your stay will be extended for an additional six months.
We do not recommend staying in the U.S. longer than 2-3 months if you are planning further visits to the country. If you stay longer, even within the legal six months, immigration officials may ask questions about your purpose of stay on your next entry.
Reasons for rejection are not usually disclosed at the interview, and sometimes it can be related to general statistics for the country. Even if you had a good chance, a rejection may be the result of choosing the wrong consulate to apply to.
To improve your chances of successfully obtaining a visa in the future, pay attention to the following points:
- Financial commitments and employment: indicate how long you have been working in one place or growing your business and what keeps you in your country (job, real estate, assets).
- Travel history: if you have traveled extensively and have always returned to your home country, this will be a positive factor for the visa officer.
- Clearly planned itinerary: We recommend preparing a detailed plan for your stay in the U.S. with specific locations and dates. It is important not to plan too long a trip (e.g. not for the whole six months), but to explain why you want to visit the chosen places.
For example, even if your visa expires in a week, you may be stamped with a stamp authorizing you to stay in the U.S. for up to six months. We recommend that you check your Form I-94, which indicates the exact length of your stay. This information can be found on the U.S. Customs and Border Protection website.
This way, you can verify how long you are allowed to stay in the country.
If you wish to change status from J1 to F1, the filing process must begin within the expiration date of Form DS-2019, which indicates the duration of your J1 program.
As USCIS points out, if you apply for adjustment of status before your current status expires, your stay will be considered legal while your case is pending, even if your status has already expired.

The F2 spouse does not have to pay the SEVIS fee (foreign student fee) or the Form I-539 fee (change of status form). Only the F1 principal applicant pays these fees.
If you leave the U.S., you will need to apply to the U.S. Consulate for a new visa that matches your new status (e.g., F1 or other status) to re-enter. Only with the visa will you be able to re-enter the United States.
